I. Conditions of sale

1. Overview

The present terms and conditions apply to the Unique Eden website and all orders delivered in Switzerland and worldwide.

Unique Eden may at any time revise the terms of these conditions.

2. Availability

Unique Eden will process as quickly as possible the orders within the availability of the stock.

When a product is not available after the confirmation of an order on the website, Unique Eden will inform the customer and can arrange partial delivery.

3. Price

All prices are dispayed in CHF, EUR and USD. The prices in CHF include the legal VAT applied in Switzerland. The prices displayed in EUR and USD are destined to countries outside of Switzerland and are displayed excluding tax.

VAT outside of Switzerland

For all orders placed outside of Switzerland, Unique Eden bears the shipping costs. The customer remains the importer of the ordered products. The local VAT and any potential local taxes required remain the responsibility of the customer. Please contact your local authorities for any information regarding local taxes.

Unique Eden hereby reserves the right to modify at any time the prices on the website. The duration and validity of promotions are determined by the website.

In rare cases, prices can be inaccurately displayed on the website due to system or typographical errors. In these circumstances, Unique Eden reserves the right to correct the errors when they appear. If an order is placed with an incorrect price, Unique Eden will notify and inform the customer and reserves the right to cancel the order.

4. Methods of payment

The customer can determine the method of payment for every order.

All payments are processed securely via Saferpay. Saferpay is a payment solution for secured online payments. All datas are transmitted via SSL encrypted communication.

Saferpay supports the following payment methods:

Visa / Master Card / American Express/ PayPal

The order of the customer will only be validated after the authorized debit of the customer’s account. When the authorization fails, the order of the customer will not be processed by the website.

5. Order confirmation

The customer can order on the website by following the different steps below:

- Add product to the basket

- Fill the shipping and billing information

- Verify the information, complete the order by selecting the payment method and fill the payment data

The customer will indicate a valid delivery address, failing which, the order can be declined. The customer is solely responsible for the failure of delivery caused by the inaccurate shipping information given during the order.

After the order has been placed, you will receive a confirmation via e-mail with the details of your order.

Cancel order

After placing an order, the customer has 24 hours to cancel his order by contacting our customer care.

6. Shipping policies

All orders are shipped in express carbon neutral and the delivery is free worldwide.

You order will be processed and shipped as quickly as possible. Shipping time can vary according to stock availability of the ordered products.

Express delivery is only possible for products that are available in stock (normal shipping time: 4-5 workdays).

If your jewelry has to be engraved or created before shipping, express delivery is unfortunately not possible. Items that are not available in stock must be created and therefore shipping time can be 20 to 30 workdays.

If multiple products are ordered simultaneously and only some are available in stock, Unique Eden will arrange partial delivery and send as soon as possible the items that are available. In such cases, Unique Eden will notify and inform the customer.

In case of shipping delay, the order in not canceled.

7. Delivery and verification at delivery

The products ordered on the website are delivered with express and registered services.

In case of inaccurate information provided by the customer, additional costs of storage or returned items are entirely at the expense of the customer. When parcels cannot be delivered due to difficulty of access not previously reported by the customer, or the absence of the customer during delivery, additional costs can be charged by Unique Eden if the order was to come back to Unique Eden.

The customer is required to verify the parcel and the order products after delivery.

Non-conforming orders

In case of complaints regarding potential defects or damaged products (missing products, damaged items, damaged parcel, etc.), the customer will notify his observations and inform the customer service within 5 days after delivery at: info@uniqueeden.com.

8. Return policy and right of withdrawal

Right of withdrawal

The customer can exercise his right of withdrawal during the 30 days to return any product, without penalty, except for the return shipping costs. The right expires 30 days after the delivery date. Unique Eden will refund the price according to the payment method chosen during the order.

In order to exercise this right, the customer must notify and inform the customer service via email before returning the products.

Refund request will only be accepted if the return process has been respected, the products are returned in their original package, in their original condition (unused, no marks, no damage, no intervention from third party), accompanied by the invoice and certificates.

The customer service will contact the customer to exchange the product or refund the product.

If the customer returns the products for a refund or to be exchanged, the return costs are at his expense.

If the customer returns products for a refund, we will refund the original price at the latest 30 days after your withdrawal right has been exercised, according to the initial method of payment.

Return for resizing

The customer has 30 days after delivery to return products for resizing or exchange purposes. The return shipping costs are at his expense and new shipping costs are the expense of Unique Eden.

In order to exercise this right, the customer must notify and inform the customer service via email before returning the products.

Return request will only be accepted if the return process has been respected, the products are returned in their original package, with the original tag attached to the jewel, in their original condition (unused, no marks, no damage, no intervention from third party), accompanied by the invoice and certificates.

Products that have been engraved or personalized creations cannot be exchanged or refunded.

 

9. Guarantee

Unique Eden guarantees all jewelry items during 1 year following the delivery of the order.

The guarantee does not apply to the loss, the damages caused by abnormal or non-conforming use, natural wear, accidental event or any intervention by any third party.

To insure that, our specialists will check and confirm that the items are conformable to the shipped products.

Return costs are at the expense of the customer. Unique Eden will bear the new shipping costs of the exchanged product.

Unique Eden commits to exchange as quickly as possible the defective products returned by the customer.

10. Retention of title

All products remain the property of Unique Eden until payment validation.

11. Competent court

The competent jurisdiction is Fribourg, Switzerland.

II. Terms of use

1. Use of website

The customer commits to providing correct, precise and actual informations when these are required. The customer will update his informations when they change.

Unique Eden may at any time revise or change the content of the website.

Unique Eden reserves the right to temporarily or permanently, with or without notice, block or limit the access to the website for maintenance purposes.

Unique Eden may cancel temporarily or permanently the account of a customer for any breach of the general terms of condition.

Jewelry pictures are displayed by way of illustration. Customer can refer to the descriptions in order to get the precise product details.

Delete user account

To delete his account, the customer must notify our customer care by email.

A user account cannot be deleted if:

- A return procedure is ongoing

- An order is in progress

- Open amounts are still due

The user account will be deleted at the latest 30 days after the last order, after the return period has run out.

2. Website content copyright

The site and all content, including texts, illustrations (icons, logo, etc.), images, are the property of Unique Eden. We will enforce our intellectual property rights against any reproduction, copy or utilization without our explicit consent.

3. Privacy policy

All the personal data are processed by Unique Eden according to our privacy policy.

By using the website, the customer accepts the use of cookies necessary to proper functioning of the website and its functionalities.

These data are collected and processed in order to manage the access to the website, to process orders, payments and billing, to improve the website services, to elaborate statistics on the use of the website and the previous orders, and for customer service purposes.

4. Liability

Unique Eden and all its employees cannot be held responsible for any damages resulting from negligence committed by the customer while using the website.
